Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Subscriber") and MyPrepPro LLC, a New Jersey limited liability company ("MyPrepPro," "we," "us," or "our"), governing your access to and use of the website at mypreppro.com, any associated applications, and all content, question banks, analytics, and services made available through them (collectively, the "Service").

By creating an account, accessing the free sample, purchasing a 24-Hour Access Pass, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Definitions

• Licensed Materials: all questions, answer options, rationales, explanations, images, diagrams, tables, study content, blueprints, analytics outputs, software, and other material made available through the Service.
• Subscription Period: the term of access you purchased, as determined under Section 10 or Section 12.
• Account: the single, individual, personal login credential issued to you.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract. The Service is intended for nursing and advanced-practice nursing students, graduates, and clinicians preparing for professional certification examinations.

You agree to provide accurate registration information and keep it current. Your Account is personal to you and may not be shared. You are responsible for all activity under your Account and for keeping your password confidential. Notify us at support@mypreppro.com if you suspect unauthorized use.

4. License Grant

Subject to your payment of applicable fees and your compliance with these Terms, MyPrepPro grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Licensed Materials for your own individual, non-commercial exam preparation and educational purposes during your Subscription Period.

You may log in from more than one personal device, but only one active session at a time.

This is a license, not a sale. Your right to access the Licensed Materials ends automatically when your Subscription Period ends unless you renew under our then-current terms and pricing. Expiration may result in loss of access to your performance history and analytics.

5. Restrictions on Use

You will not, and will not permit any third party to:

1. Share, sell, rent, lease, lend, sublicense, assign, or otherwise transfer your Account or access to the Licensed Materials;
2. Permit any other person to use your credentials, including classmates, colleagues, study groups, or family members;
3. Copy, reproduce, print, download, screenshot, screen-record, transcribe, photograph, or otherwise capture the Licensed Materials, except where we provide an explicit print or export function;
4. Reproduce or redistribute Licensed Materials in study guides, flashcards, social media posts, group chats, cloud drives, forums, note-sharing sites, or any other medium;
5. Use any robot, spider, scraper, crawler, script, browser extension, or automated means to access, monitor, or extract the Licensed Materials;
6. Use the Licensed Materials to train, fine-tune, evaluate, or ground any artificial intelligence or machine learning model, or to generate derivative question content;
7. Reverse engineer, decompile, or attempt to derive the source code or underlying structure of the Service;
8. Circumvent, disable, or interfere with any security, access-control, rate-limiting, or usage-monitoring feature;
9. Use the Service to build, market, or support a competing product or service;
10. Remove, obscure, or alter any copyright, trademark, or proprietary notice.

Account monitoring. We monitor Account and usage activity to enforce these Terms and protect the Service. This may include the number and timing of active sessions, login frequency, request volume, and patterns indicating automated access. The categories of data we collect for this purpose are described in our Privacy Policy.

If we reasonably determine that your Account is being shared or that Licensed Materials are being extracted, we may suspend or terminate your Account without notice and without refund, and pursue any remedy available at law, including for breach of contract and copyright infringement.

6. Original Content; Relationship to Certification Examinations

The questions and rationales offered through the Service are developed as original educational content for MyPrepPro and are not actual, recalled, reproduced, or reconstructed certification examination items. They are written with reference to publicly published examination blueprints and content outlines.

We do not solicit, accept, or use recalled or leaked examination content. If you have taken a certification examination, you remain bound by that organization's confidentiality obligations, and you must not submit remembered or recalled examination questions to us through feedback forms, email, or any other channel. Any such submission may result in termination of your Account.

7. Trademarks and No Affiliation

MyPrepPro is an independent examination-preparation provider and is not affiliated with, endorsed by, sponsored by, or approved by the American Nurses Credentialing Center (ANCC), the American Academy of Nurse Practitioners Certification Board, Inc. (AANPCB, doing business as NPCB), or any other certification or testing organization, school, or employer.

PMHNP-BC®, PMHNP-C, NP-C®, ANCC®, AANPCB®, NPCB, and all other examination names, credentials, logos, and marks referenced on the Service are trademarks or registered trademarks of their respective owners. References are made solely for identification and descriptive purposes.

"MyPrepPro," our logo, and our other marks are our property and may not be used without our prior written permission.

8. No Guarantee of Examination Results; Readiness Indicators

We do not guarantee that you will pass any examination. Outcomes depend on many factors outside our control, including your preparation, prior education, clinical experience, and test-day performance.

Any readiness score, predicted-performance band, percentile, mastery level, or similar output shown by the Service is an estimate based on your activity within the Service only. It is intended to guide your studying. It is not a prediction, forecast, or guarantee of your actual examination result, is not derived from or validated against any certification body's scoring, and should not be relied on in deciding whether to sit for an examination.

Testimonials or reported outcomes describe individual experiences and are not a promise of your results.

9. Educational Use Only, Not Clinical Advice

The Licensed Materials are provided for examination preparation and educational purposes only. They are not medical, nursing, psychiatric, pharmacological, diagnostic, or legal advice, and must not be used for the diagnosis, treatment, prescribing, or management of any patient.

Clinical standards change. You are solely responsible for verifying current guidelines, drug information, dosing, scope of practice, and applicable law before applying any information to patient care. Clinical vignettes are fictional; any resemblance to actual patients is coincidental. Nothing in the Service creates a clinician-patient or professional-client relationship.

10. Subscriptions, Fees, and Automatic Renewal

Our plans. The Service is offered as: a free sample of 20 questions; a 24-Hour Access Pass at $2.99 (one-time); a Monthly subscription at $14 per month (recurring); and a 6-Month plan at $74 (one-time, 180 days of access). Current pricing is always as displayed at checkout.

Start of access. Except for the 24-Hour Access Pass described in Section 12, your Subscription Period begins immediately upon successful payment and runs continuously for the duration purchased. Subscriptions cannot be paused, frozen, or extended except as expressly stated or at our discretion.

Payment. You authorize us and our payment processor to charge your payment method for all fees plus applicable taxes, and you represent that you are authorized to use that payment method. We use a third-party processor (Stripe); we do not store full card numbers.

AUTOMATIC RENEWAL, MONTHLY PLAN ONLY. If you purchase the Monthly subscription, it automatically renews each month at $14 (or the then-current price) and your payment method is charged on each renewal date until you cancel. The renewal terms are disclosed to you before purchase, you affirmatively consent to them at checkout, and we confirm the terms and how to cancel by email after your first charge.

Cancellation. You may cancel automatic renewal at any time, at no cost and without contacting us, using the subscription management link in your account, which opens our payment processor's customer portal. Cancellation takes effect at the end of your current billing month. It stops all future charges. It does not shorten the current month and does not refund it, you keep full access through the period you have already paid for. See Section 11.

Failed payments. If a renewal payment fails, we will notify you by email and the payment may be retried. Your access continues through the period you have already paid for.

The 24-Hour Access Pass and the 6-Month plan do not auto-renew. Each is a one-time purchase that expires at the end of its term with no further charge. To continue, you purchase again.

Price changes. We may change prices. Changes never affect a period already paid for, and we will give at least 30 days' notice before a change applies to a renewal.

Discounts. Promotional codes and student or institutional rates carry their own terms, may not be combined, and may be revoked if obtained or used improperly.

11. Refunds

This section is about refunds. It does not limit your right to cancel automatic renewal, which you may do at any time under Section 10.

Before purchasing a subscription, you can review the Service through the free 20-question sample and, if you want a fuller look, the 24-Hour Access Pass (both described in Section 12).

Payments are final and are not refunded for the current paid period, including for:

• unused subscription time or unattempted questions;
• change of mind or dissatisfaction with content;
• duplicate or accidental purchase;
• purchasing the wrong plan or certification track;
• postponing, rescheduling, cancelling, or not passing your examination;
• loss of access to a device or internet connection; or
• not using the Service during your Subscription Period.

The 24-Hour Access Pass is non-refundable, except where a refund is required by applicable law.

We may issue a refund at our discretion in individual cases. Doing so once does not create an obligation to do so again.

Accounts terminated for violation of Section 5 are not refunded, and remaining subscription time is forfeited.

Payment disputes. Please email support@mypreppro.com before initiating a chargeback, most issues are resolved quickly. We may suspend an Account while a payment dispute is pending.

Third-party purchases. Subscriptions bought through an app store, reseller, employer, or institution are governed by that party's refund policy.

12. Free Sample and 24-Hour Access Pass

Free sample. Registered users receive a sample of 20 questions at no charge. The sample is for evaluation, is limited to one per person, and may not be repeated by creating additional accounts or using additional email addresses. All of these Terms, including Section 5, apply to it.

24-Hour Access Pass, $2.99. A low-cost option for a fuller review before committing to a longer-term subscription. It is subject to these Terms in full, and specifically:

• When the clock starts. The 24-hour period begins immediately when you complete your purchase, not when you first open a question. Access expires 24 hours later. Expiration is automatic; the Pass cannot be paused, extended, or reactivated. Plan to use it when you have time to study.
• If you already have access. If you buy a Pass while you already have an active unlimited subscription, the 24 hours is added to the end of your existing access rather than running at the same time, so you do not lose the time you paid for.
• Non-renewing. The Pass does not automatically renew and does not convert into a paid subscription. You will not be charged again unless you make a new purchase.
• Non-refundable. See Section 11.
• One per person. Creating additional accounts or using additional email addresses to obtain repeat Passes breaches these Terms and may result in termination without refund.
• Scope. The Pass may include a limited subset of the Licensed Materials and features, as described at checkout, and that subset may change.

We may modify, suspend, or discontinue the free sample or the Pass at any time. Changes will not affect a Pass already purchased.

13. Your Content and Feedback

The Service may let you submit question feedback, error reports, comments, notes, testimonials, or other material ("User Content"). You keep ownership of your User Content. You grant MyPrepPro a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and incorporate it into the Service and our products, without compensation or attribution.

You represent that your User Content is yours, infringes no third-party rights, and contains no confidential examination content (Section 6), protected health information, or patient-identifying information. Do not submit PHI. We may remove any User Content at our discretion.

14. Prohibited Conduct

In addition to Section 5, you will not use the Service to violate any law; infringe intellectual property; harass, threaten, or abuse any person or our staff; upload malware; impersonate anyone; misrepresent your identity, credentials, or eligibility for a discount; or interfere with the integrity or performance of the Service.

15. Suspension and Termination

We may suspend or terminate your Account, with or without notice, if you breach these Terms, if we suspect fraudulent or unlawful activity, or if required by law. Termination for breach forfeits remaining subscription time without refund. You may stop using the Service at any time and may request Account deletion as described in our Privacy Policy. Sections 4 (final paragraph), 5, 7-9, 13, and 16-24 survive termination.

16. Intellectual Property

The Service and all Licensed Materials are owned by MyPrepPro and its licensors and protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted in Section 4 are reserved. Nothing in these Terms transfers any ownership interest to you.

17. Copyright Complaints

If you believe material available through the Service infringes your copyright, contact us at legal@mypreppro.com with: identification of the work you claim is infringed; identification of the material you claim is infringing and its location on the Service; your contact information; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; a statement that the information in your notice is accurate; and your physical or electronic signature.

We investigate all complete notices, remove or disable material where appropriate, and may terminate the accounts of repeat infringers.

18. Third-Party Links and Services

The Service may link to or integrate third-party sites and services. We do not control and are not responsible for their content, policies, or practices. Your dealings with them are between you and them.

19. Availability and Changes to the Service

We aim for continuous availability but do not guarantee it. Access may be interrupted for maintenance, updates, or events beyond our control. The Licensed Materials may be revised, corrected, expanded, or reduced during a Subscription Period, and the number of questions available may change as items are added, retired, or edited.

20. Disclaimer of Warranties

THE SERVICE AND LICENSED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPREPPRO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE LICENSED MATERIALS ARE COMPLETE, CURRENT, OR ACCURATE.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPREPPRO AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AUTHORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST STUDY TIME, EXAMINATION FAILURE, DELAYED OR DENIED CERTIFICATION OR LICENSURE, LOST EMPLOYMENT OR INCOME, OR ANY CLINICAL OR PATIENT-CARE OUTCOME, arising out of or relating to the Service, however caused and on any theory of liability.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO MYPREPPRO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. These limitations apply even if a remedy fails of its essential purpose.

22. Indemnification

You agree to indemnify, defend, and hold harmless MyPrepPro and its officers, members, employees, and contractors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your breach of these Terms, your violation of any law or third-party right, or your application of any information from the Service to patient care.

23. Dispute Resolution; Arbitration; Class Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

By agreeing to these Terms, you are giving up your right to go to court. If a dispute arises between you and MyPrepPro, you will not be able to file a lawsuit in a court of law, and you will not be able to have your claim decided by a judge or a jury. Instead, the dispute will be decided by a single private arbitrator.

Arbitration is different from going to court. In arbitration there is no jury. The process is more informal, the ability to obtain documents and information from the other side is more limited than in court, and the arbitrator's decision is final, it can be appealed only in very narrow circumstances. An arbitrator can award the same individual remedies a court could, including money damages.

You also give up the right to participate in a class action. You and MyPrepPro may bring claims against each other only individually, and not as a plaintiff or member of any class, collective, or representative proceeding. An arbitrator cannot combine your claim with anyone else's.

Informal resolution first. Before starting arbitration, you agree to contact us at legal@mypreppro.com and try in good faith to resolve the dispute for at least 30 days.

How arbitration works. Any dispute not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. The arbitration will take place in Morris County, New Jersey, or by videoconference if you choose.

What is not covered. You may still bring an individual claim in small-claims court if it qualifies. Either party may also ask a court for an injunction to protect intellectual property or stop unauthorized access to the Service.

You can opt out. You are not required to accept arbitration. You may opt out of this Section 23 by sending written notice to legal@mypreppro.com within 30 days of first accepting these Terms, stating your name and that you decline arbitration. Opting out costs nothing, will not affect your subscription or your use of the Service, and does not change any other part of these Terms. If you opt out, disputes between us will be resolved in court under Section 24.

24. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. Subject to Section 23, the exclusive venue for any action is the state and federal courts in Morris County, New Jersey, and you consent to their jurisdiction.

Nothing in this Section deprives you of the protection of any mandatory consumer-protection provision of the law of the state where you reside that applies to you regardless of this choice of law.

25. Geographic Restrictions

You represent that you are not located in, and will not access the Service from, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list. We may restrict access based on jurisdiction.

26. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what we collect, how we use it, and your rights.

27. Changes to These Terms

We may update these Terms. We will post the revised version with a new "Last updated" date and, for material changes, give notice by email or in-product notice at least 15 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and contact us about your subscription.

28. General

Entire agreement. These Terms, the Privacy Policy, and your order confirmation are the entire agreement between us and supersede prior understandings.

Severability. If a provision is held unenforceable, the remainder stays in effect.

No waiver. Failure to enforce a provision is not a waiver.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.

Notices. We may give notice by email to your account address or by posting in the Service.
