Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and MyPrepPro LLC ("MyPrepPro," "we," "us," or "our"), governing your access to and use of the MyPrepPro website, application, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Description of Service

MyPrepPro provides an online question bank, practice exams, flashcards, and related study resources intended to help nursing professionals prepare for the ANCC PMHNP-BC and AANPCB PMHNP certification examinations.

MyPrepPro is an independent, unaffiliated study resource.

MyPrepPro is not affiliated with, endorsed by, or sponsored by the American Nurses Credentialing Center (ANCC), the American Association of Nurse Practitioners Certification Board (AANPCB), or any professional licensing or credentialing body. References to ANCC, AANPCB, PMHNP-BC, or any related certification names are used solely to describe the subject matter the Service addresses.

3. No Guarantee of Exam Results

The Service is an educational study aid only. MyPrepPro does not guarantee that use of the Service will result in passing any certification examination, and makes no representation as to the accuracy, completeness, or currency of any question, answer, rationale, or other content on the Service at any given time, notwithstanding our efforts to maintain accurate and up-to-date content.

You acknowledge that:

• Certification exam content, format, and passing standards are determined solely by ANCC, AANPCB, or the relevant credentialing body and may change without notice;
• Practice questions on the Service are study aids and may not reflect the exact content, format, or difficulty of any actual certification examination;
• Your performance on the Service is not a prediction of your performance on any actual examination.

4. Not Medical or Clinical Advice

Content on the Service (including questions, answer rationales, and any reference material) is provided for educational and exam-preparation purposes only. It does not constitute, and should not be relied upon as, medical advice, clinical guidance, or a substitute for professional clinical judgment, supervision, current prescribing information, or continuing education requirements applicable to your practice.

You are responsible for verifying any clinical, pharmacological, or diagnostic information against current, authoritative sources (e.g., FDA labeling, current clinical practice guidelines) before applying it in any clinical setting. MyPrepPro is not liable for any clinical decision made in reliance on Service content.

5. Accounts

To access certain features of the Service, you must create an account. You agree to:

• provide accurate and complete information when creating your account;
• maintain the security of your password and account credentials;
• notify us promptly of any unauthorized use of your account;
• be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, that we reasonably believe are being used fraudulently or abusively, or for content-integrity reasons (e.g., automated scraping of the question bank).

6. Subscriptions, Trials, and Payment

Certain features of the Service require a paid subscription. By purchasing a subscription, you agree to pay the fees displayed at the time of purchase.

Free trial. We may offer a free or limited trial period. At the end of any trial, continued access to full features requires an active paid subscription, as described on the Service at the time of your trial.

Billing. Subscriptions are billed in advance on a recurring basis (as selected at purchase, e.g., monthly, quarterly) unless cancelled prior to renewal.

Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial-period refunds except as required by law or as we may otherwise decide at our discretion.

Price changes. We may change subscription pricing prospectively, with notice, for future billing cycles.

Payment processing. Payments are processed by a third-party payment processor. We do not store your full payment card details on our own servers.

7. Acceptable Use

You agree not to:

• share your account credentials with, or provide access to, any other person;
• copy, scrape, reproduce, redistribute, resell, or create derivative works from the question bank, flashcards, or other Service content;
• use any automated means (bots, scripts, scrapers) to access or extract content from the Service;
• reverse-engineer or attempt to extract the underlying question data or source code of the Service;
• use the Service for any unlawful purpose or in violation of these Terms.

We reserve the right to suspend or terminate access for violation of this section, including sharing of a single account among multiple users.

8. Intellectual Property

All content on the Service (including questions, answer choices, rationales, flashcards, text, graphics, logos, and the compilation and arrangement thereof) is the property of MyPrepPro LLC or its licensors and is protected by copyright and other intellectual property laws. Except for the limited right to access and use the Service for your personal, non-commercial exam preparation, no right, title, or interest in the content is transferred to you.

9. User Feedback and Content

If you submit feedback, corrections, or reports regarding question content ("User Feedback") through the Service, you grant MyPrepPro a perpetual, irrevocable, royalty-free license to use, incorporate, and modify that feedback without obligation or compensation to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS FREE OF ERRORS OR OMISSIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYPREPPRO LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING WITHOUT LIMITATION ANY DAMAGES RELATED TO EXAMINATION OUTCOMES OR CLINICAL DECISIONS.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless MyPrepPro LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service and cancel your account at any time. Sections of these Terms that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as by posting an updated date or notifying you via email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles, and any disputes shall be resolved in the state or federal courts located in New Jersey.
